Terms and Conditions of Hofmann Experience GmbH

§1 Scope vis-à-vis Entrepreneurs and Definitions

(1) The following Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession (§ 13 BGB).

§2 Conclusion of Contract, Storage of Contract Text

(1) The following provisions apply to contracts concluded via our online shop at https://www.kitzbuehel-shop.com.

(2) In the event of a contract, the contract is concluded with:

(3) The presentation of goods in our online shop does not constitute a legally binding offer, but a non-binding invitation to consumers to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) When an order is placed in our online shop, the following process applies: the consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order is placed in the following steps:

  1. Select the desired goods.

  2. Confirm by clicking the “Order” button.

  3. Review the information in the shopping cart.

  4. Click the “Checkout” button.

  5. Log in to the online shop after registering and entering user data (e-mail address and password).

  6. Review and, if necessary, correct the data entered.

  7. Submit the binding order by clicking the “Place order with obligation to pay” / “Buy” button.

Before submitting the binding order, the consumer can return to the page on which the customer’s details are recorded and correct input errors by using the “Back” function of the internet browser used and, if necessary, cancel the order process by closing the internet browser. We immediately confirm receipt of the order by an automatically generated e-mail (“order confirmation”). With this e-mail, we accept your offer.

(5) Storage of the contract text for orders via our online shop: We will send your order data and our Terms and Conditions by e-mail. You can also access the Terms and Conditions at any time at https://www.thelionsgame.com/agb. For security reasons, your order data are no longer accessible via the internet after completion.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The prices stated include statutory VAT and other price components. Any shipping costs are added.

(2) The consumer may pay by direct debit, PayPal, or credit card (Visa, Mastercard, American Express).

§4 Delivery

(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for dispatch immediately. Delivery takes place no later than within 5 working days. The delivery period begins, in the case of advance payment, on the day after the payment order is issued to the transferring bank, and for all other payment methods, on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item shall pass to the buyer only upon handover of the item to the buyer, including in the case of a sale by dispatch.

§5 Retention of Title

We retain title to the goods until the purchase price has been paid in full.

§6 Warranty

The statutory warranty provisions apply.

§7 Contract Language

The contract language is exclusively German.
